Kevin M. Estevez is a member of Holden Willits PLC.  His practice focuses on construction law and commercial litigation.  He represents general contractors, subcontractors, material suppliers, architects, engineers, and business owners in construction and business matters, including litigation, arbitration, Arizona Registrar of Contractors complaints, contract review and drafting, and entity formation and licensing. 

Mr. Estevez is a frequent writer on issues affecting the construction industry.  He is the author of Arizona Construction and the Law, a legal blog providing an informative look at construction law in Arizona.

Mr. Estevez has successfully litigated cases in Arizona and federal courts, in arbitrations, and before various administrative bodies. 

Mr. Estevez is a past president (2015-2016) of the Scottsdale Bar Association and continues to serve on its board of directors.  He is a Southwest Super LawyersTM honoree for 2022 and 2023 for Construction and Business Litigation, and a Best Lawyers in America® honoree for 2024 for Construction Law and Commercial Litigation.  He was also a Southwest Super LawyersTM rising star selectee from 2013 to 2019, a Charter Fellow of the Construction Lawyers Society of America, and has a strong track record of achieving results for his clients in a wide range of disputes.

  • Won $1.4 million arbitration award and subsequent judgment for a property owner against a general contractor and surety on termination for cause and performance bond claims.
  • Obtained $1.4 million settlement for partners after arbitrating the dissolution of a single asset partnership.
  • Settled dispute in arbitration over the dissolution of five limited liability companies that owned real property assets collectively valued at several million dollars.
  • Procured $800,000 settlement for a multi-state construction supplier in a lawsuit against a general contractor spanning multiple projects.
  • Recovered $380,000 for a multi-state construction supplier as a result of a settled lawsuit asserting breach of contract and Little Miller Act claims against a general contractor.
  • Won $250,000 judgment in favor of a landlord and against a tenant for breach of a commercial lease.
  • Obtained $175,000 for subcontractor after defeating general contractor’s pay-if-paid clause defense on summary judgment just before trial.
  • Obtained $160,000 recovery for homeowners as a result of a settled lawsuit asserting breach of contract and fraud claims resulting from defective construction work.
  • Recovered 100% of the principal, interest, attorneys’ fees, and cost sought in lawsuit against retailer to foreclose on a mechanic’s lien.
  • Recovered 100% of the principal, interest, attorneys’ fees, and cost sought in lawsuit against equipment rental company to foreclose on a mechanic’s lien.
  • Won dismissal of claims against foreign limited liability company for lack of personal jurisdiction, including an award of the client’s attorneys’ fees and costs.
  • Won dismissal of IDEA claims against a charter school alleging that a student had been denied a “free and appropriate public education.”
  • Won dismissal of a bank’s $1 million dollar deficiency claim against client, with an award of client’s attorneys’ fees and costs.
