Ruth Franklin holds an “of
counsel” position with the firm, with a focus on providing alternative
dispute resolution services.
Ms. Franklin’s career as an
ADR professional encompasses over 18 years of experience working with
contractors, subcontractors, owners, developers, municipalities, design
professionals and insurance carriers to achieve resolution of complex
disputes. Her deep understanding of the construction, design, and
insurance industries facilitates the parties’ informed decision-making
and creative solutions in mediation.
Ms. Franklin has served both
as a sole arbitrator and the chairperson of panel arbitrations in
complex commercial and construction matters and has created custom ADR
processes to address the individualized needs of the parties.
Additionally, Ms. Franklin works within the corporate environment
creating training programs for managers and employees to gain the
benefits of the ADR process.
Applying her unique blend of
civil engineering knowledge combined with legal experience, Ms. Franklin
has resolved matters that involved: construction defect in industrial,
commercial, single family and multifamily developments; contract and
specification interpretation; change order disputes; architectural and
engineering design deficiencies; construction management; substitution
of “in kind” materials; methodology for calculation of payment
quantities; substantial completion and release of retention funds; delay
and liquidated damage claims.
Ms. Franklin is a
professional civil engineer licensed in Arizona and California as well
as an attorney admitted to the Arizona, California and Utah bars. She
graduated in 1989 from the University of San Diego School of Law and was
nominated to the school’s law review. She earned her Bachelor of Science
degree in Civil Engineering from San Diego State University in 1982. |
